Samnytt’s article series about perceived deficiencies in legal certainty at the Migration Agency has led to the issue being raised in parliament. In written questions to the government, Sweden Democrat MPs demand answers on how the information will be handled. Minister for Migration Johan Forssell (M) states in a joint response that the government is monitoring developments and is ready to take further measures if necessary.

Samnytt’s reporting on the situation at the Migration Agency has brought political attention to the matter. Members of Parliament Markus Wiechel (SD) and Björn Söder (SD) have in written questions to Minister for Migration Johan Forssell (M), referenced information from the paper’s article series and requested the government’s view on possible risks to legal certainty in the handling of migration cases.

Through the parliamentary questions, the revelations raised in Samnytt’s investigation have become subject to formal political scrutiny. This means that the issue of legal certainty and consistency in the migration process will continue to be monitored within the parliament’s oversight of the government’s management of its agencies.

In the letter from Markus Wiechel (SD), we can read, among other things:

“According to an article published on the news site Samnytt, anonymous sources with long experience from the authority have testified to a work culture where a majority of staff have a foreign background, where employees in open-plan offices often group themselves according to language and ethnicity, and where languages other than Swedish are freely used in everyday conversations.

The sources further describe how clan loyalties and foreign allegiances are said to affect the processing of cases, including employees actively working to facilitate residence permits, work permits, or other decisions for relatives and clan members.

This is said to have become so normalized that it occurs openly, while criticism of the conditions is silenced through informal sanctions. The statements point to a risk that legal certainty is being eroded from within, with decisions possibly being made on group affiliation rather than based on objective and consistent legal examination.”

Government Points to Previous Measures

In their joint reply, Minister for Migration Johan Forssell (M) stresses that the Migration Agency, like other authorities, should be characterized by impartiality and objectivity, and that any shortcomings are to be investigated. He also points out that the government in recent years has given several assignments aimed at strengthening quality and uniformity in the asylum process.

The government continues to closely monitor the issue and has, in the instruction letter for 2026, tasked the Migration Agency with reporting on the outcome of measures taken to increase uniformity and legal quality in case processing. If necessary, the government is ready to take further action.

Among other things, in 2023 the Swedish Agency for Public Management (Statskontoret) was tasked with reviewing the asylum process, focusing on legal quality and predictability in decision-making. Based on this review, the government has in subsequent instructions tasked the Migration Agency with actions to improve the follow-up of cases and ensure more consistent application of legislation.

According to the government, work is ongoing within the agency to strengthen oversight and develop internal routines.

The Issue Is Now Part of Political Review

Through the parliamentary questions, the information highlighted in Samnytt’s investigation has become the subject of formal political handling. This means that the issue of legal certainty and uniformity in the migration process will continue to be followed up within the framework of the parliamentary oversight of the government’s management of its authorities.

Similar concerns have previously been noted in reviews from the Swedish Agency for Public Management (Statskontoret) and the Parliamentary Ombudsman, where the need for more consistent legal application and improved internal controls within the asylum process has been highlighted.

How the Migration Agency presents results for the measures now demanded by the government is expected to be decisive for the continued political handling of the issue.
