19-year-old Mahammed Al-Badry did not like being taken into custody by the police. After calling the constables “whores” and threatening to urinate in their mothers’ mouths, he attacked one of the police officers with a kebab roll as a weapon. He is now sentenced to one year and three months in prison.
It was on the evening of June 15 last year that Mahammed and a number of other immigrant youths were standing and shouting outside a hotel in central Halmstad. Police were called to restore order. The others in the group walked away, but Mahammed couldn’t tolerate the reprimand.
He became verbally abusive and showered the constables in the responding patrol with insults, calling them “whores” and more. He also said that he would urinate in one of the police officers’ mother’s mouth, among other things.
Hit policeman in the head with kebab roll
When the police officers grew tired of the disorder and tried to remove Mahammed from the scene, he became physically aggressive. One of the constables received blows to the head with a kebab roll.
“I have to wipe off sauce and food from the back of my head. At that moment, I am shocked by what happened and I don’t really understand that he hit the food on the back of my head,” said the police officer in his account of the incident.
At the same time, he emphasized that he found Mahammed’s behavior offensive.
“I feel that in my professional practice, I should not have to endure someone hitting me with a kebab roll or similar on my head, that I should have to wash my clothes and clean my equipment because a person can’t behave properly,” the police officer said.
Had to be provided with spit hood when blood sample was taken
As suspicion arose that Mahammed was under the influence of drugs, he was taken to the police station for a urine test. There, he continued to be verbally abusive, saying things like “your mother is a whore, cunt, your whore, going to fuck your mother, going to piss in your mother’s mouth,” and more.
Mahammed refused to provide a urine sample. He was then taken to the hospital for a blood test. During the journey there, the insults continued. Mahammed also started spitting at the police officers and was therefore provided with a so-called spit hood.
In questioning and during the trial, Mahammed denied hitting the police officer in the head. However, the video evidence from the intervening police officers’ body cameras speaks for itself. The court considers Mahammed guilty of assaulting a public official.
The numerous offensive insults that another police officer had to endure were also deemed by the court to reach the level of unlawful insult.
Released, stole a car, and committed burglary
After the sampling at the hospital, the police patrol chose to release Mahammed. This led to him later participating in a burglary and car theft and being arrested by the police after a short car chase, during which he and an accomplice fled on foot from the car. The accomplice got away, but Mahammed was found hiding in a bush.
Therefore, Mahammed is also convicted of aggravated unauthorized use of a vehicle and burglary. This despite his denial, where he tried to blame others, whom he refused to name, for the crimes.
He is also convicted of drug offenses. The total penalty for the crimes amounts to 1 year and 3 months in prison. However, he only needs to serve 10 months of the sentence, as one-third is deducted as a sentence reduction according to practice.
Verbally offended policeman denied compensation
Mahammed is also required to pay several damages to his victims. The police officer who was hit in the head is awarded 8,000 SEK for the offense. The person whose home he broke into and from whom he stole, among other things, a wedding ring, is awarded 25,000 SEK in damages.
Furthermore, Mahammed is to pay over 5,000 SEK to the owner of the stolen car. However, Halmstad District Court rejects the compensation claim from the police officer who endured a tirade of verbal abuse. The court finds these to be offensive but not sufficient to warrant any compensation.
Previously convicted of crimes
Mahammed is no stranger to criminal activities. He has previously been convicted of, among other things, threatening a public official and received a penalty order for drug offenses.
